These Terms & Conditions (“Terms”) govern your access to and use of Shared List App’s mobile application, website, and related services (the “Service”). By using the Service, you agree to these Terms.
The Service
The Service allows you to create, organize, and share lists and related content. We may modify, suspend, or discontinue features with reasonable notice where practicable.
Accounts
You are responsible for safeguarding your account credentials and for activity under your account. You must provide accurate information and notify us promptly of unauthorized use.
Acceptable use
You agree not to:
- Use the Service in violation of law or third-party rights;
- Attempt to gain unauthorized access to the Service, other users’ data, or our systems;
- Interfere with or disrupt the Service or its infrastructure;
- Use the Service to distribute malware, spam, or harmful content;
- Reverse engineer or attempt to extract source code except where permitted by law.
Your content
You retain ownership of content you submit. You grant us a limited license to host, process, and display your content solely to operate and improve the Service and as you direct (for example, when you share a list). You are responsible for your content and for having the rights needed to share it.
Intellectual property
The Service, including its branding, software, and documentation, is owned by Shared List App and its licensors and is protected by intellectual property laws.
Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SHARED LIST APP AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50), IF YOU HAVE NOT PAID US ANYTHING.
Indemnity
You will defend and indemnify Shared List App and its affiliates against claims arising from your content, your use of the Service, or your violation of these Terms, subject to applicable law.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we must do so to comply with law or protect the Service. Provisions that by their nature should survive will survive termination.
Governing law
These Terms are governed by the laws applicable in your principal place of residence or, if you are a business, the laws of the jurisdiction in which you operate, excluding conflict-of-law rules, except where mandatory consumer protections in your region apply.
Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance unless applicable law requires additional consent.
